1. Introduction & Acceptance of Terms
Welcome to MyBrand (“MyBrand,” “we,” “us,” or “our”). MyBrand provides software-as-a-service (“SaaS”) solutions designed to help businesses automate, manage, and grow their operations.
By accessing, subscribing to, or using any MyBrand services, websites, software, tools, or platforms (collectively, the “Services”), you agree to be bound by these Terms of Service & Policies (“Terms”). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you (“Client,” “you,” or “your”) and MyBrand.

3. Eligibility & Account Responsibility
You must be at least 18 years of age and have the legal authority to enter into this agreement to use MyBrand Services.
You are responsible for:
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Ensuring that your use of the Services complies with applicable laws and these Terms
MyBrand is not responsible for unauthorized access caused by your failure to safeguard account credentials.
4. Subscription Services & Billing
MyBrand offers subscription-based services, which may include monthly, annual, or custom billing arrangements.
By subscribing, you authorize MyBrand to:
Charge your payment method on a recurring basis
Automatically renew your subscription unless properly canceled
Collect applicable taxes, fees, or charges as required by law
All billing, cancellation, and refund terms are governed by the Cancellation Policy and Refund Policy, which control in the event of any conflict.
5. No Guarantees of Results
MyBrand provides tools, software, and automation systems only. We do not guarantee specific business results, revenue outcomes, lead volume, sales performance, or profitability.
Success depends on multiple factors outside MyBrand’s control, including but not limited to:
Client implementation
Market conditions
Industry factors
Client responsiveness and effort
6. Acceptable Use & Prohibited Activities
You agree not to:
Use the Services for unlawful, fraudulent, or deceptive purposes
Attempt to reverse engineer, copy, resell, sublicense, or exploit the platform without authorization
Interfere with system integrity, security, or performance
Use the Services in violation of any applicable laws or regulations
MyBrand reserves the right to suspend or terminate accounts engaged in prohibited activities without notice.
7. Suspension & Termination
MyBrand may suspend or terminate your access to the Services, with or without notice, for reasons including but not limited to:
Non-payment
Violation of these Terms or any incorporated policy
Fraud, abuse, or misuse of the platform
Legal or regulatory requirements
Termination does not entitle you to a refund unless expressly stated in the Refund Policy.
8. Intellectual Property
All MyBrand software, systems, designs, content, trademarks, and intellectual property remain the exclusive property of MyBrand.
Clients are granted a limited, non-exclusive, non-transferable right to use the Services during an active subscription period only.
No ownership rights are transferred under this agreement.
9. Data & Content
You retain ownership of your data submitted through the Services. By using MyBrand, you grant us the right to process, store, and use such data solely to provide and improve the Services.
You are responsible for exporting your data prior to cancellation or termination. MyBrand is not liable for data loss after account closure.
10. Service Availability
MyBrand strives to maintain reliable service but does not guarantee uninterrupted access or error-free operation.
Scheduled maintenance, updates, or unforeseen events may result in temporary service interruptions. No refunds or credits are provided for downtime.
11. Disclaimer of Warranties
The Services are provided on an “AS IS” and “AS AVAILABLE” basis.
MyBrand disclaims all warranties, express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
12. Limitation of Liability
To the maximum extent permitted by law:
MyBrand’s total liability shall not exceed the amount paid by you for the Services during the current billing period
MyBrand shall not be liable for indirect, incidental, consequential, special, or punitive damages
13. Indemnification
You agree to indemnify and hold harmless MyBrand from any claims, damages, losses, or expenses arising from:
Your use of the Services
Your violation of these Terms
Your violation of applicable laws or third-party rights
14. Modifications to Terms
MyBrand reserves the right to modify these Terms at any time. Updated Terms will be posted on our website or communicated electronically.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Cobb County, Georgia.
